Privacy Policy

1. Who we are

humcall.ai (the "Site") and the humcall AI voice agent service (the "Service") are operated by HummingAgent ("HummingAgent," "we," "us," or "our"). This Privacy Policy explains what information we collect, how we use it, who we share it with, and the choices you have. It applies to visitors of the Site, to our business customers ("Customers"), and to people who call phone lines answered by humcall voice agents ("Callers").

2. Information we collect through the Site

When you visit the Site, we collect information that your browser sends automatically, such as your IP address, browser type, device type, operating system, referring pages, and the pages you view along with timestamps. We use this information to operate and secure the Site and to understand how visitors use it in aggregate.

When you contact us by email or schedule a call through our booking link, we receive the information you choose to provide, such as your name, email address, phone number, company name, and the content of your message. Scheduling is handled by a third-party booking provider, and your use of that provider is also governed by its own privacy policy.

3. Information we collect through voice agent calls

When a Caller reaches a phone line answered by a humcall voice agent, we collect and process information needed to handle the call on behalf of our Customer. This can include the Caller's phone number, the audio of the call, a transcript of the conversation, and details the Caller shares during the call, such as their name, callback number, service address, the reason for the call, scheduling preferences, and answers to the Customer's intake questions.

Calls handled by humcall voice agents may be recorded and transcribed. Callers are informed at the start of the call that they are speaking with an AI assistant and that the call may be recorded. A Caller who does not wish to be recorded can say so, hang up, or ask to be transferred to a person where the Customer has configured a transfer option.

For call handling, we act primarily as a service provider to our Customers, who direct what information the voice agent collects. Callers who have questions about how a specific business uses their call information should contact that business directly. We will assist our Customers in responding to such requests.

4. How we use information

We use the information described above to:

  • Provide, operate, maintain, and improve the Site and the Service;
  • Answer, qualify, route, and schedule calls as configured by the relevant Customer;
  • Deliver call summaries, transcripts, recordings, and booking details to the relevant Customer;
  • Respond to inquiries and provide customer support;
  • Monitor quality, troubleshoot issues, and improve the accuracy and safety of our voice agents;
  • Protect against fraud, abuse, and security threats;
  • Comply with legal obligations and enforce our agreements.

We do not sell personal information, and we do not use the content of Customer calls for advertising.

5. How we share information

We share information only as follows:

  • With our Customers. Call recordings, transcripts, summaries, and booking details from calls to a Customer's line are shared with that Customer.
  • With service providers. We use vendors for telephony, speech processing, hosting, scheduling, and analytics. They may process information only to provide services to us and are bound by confidentiality obligations.
  • For legal reasons. We may disclose information when required by law, legal process, or a governmental request, or when we believe disclosure is necessary to protect rights, safety, or the integrity of the Service.
  • In a business transfer. If HummingAgent is involved in a merger, acquisition, or asset sale, information may be transferred as part of that transaction, subject to the commitments in this policy.

6. Cookies and similar technologies

The Site uses only the cookies and local storage necessary for it to function and, where enabled, privacy-respecting analytics to measure aggregate traffic. You can control cookies through your browser settings. Blocking cookies may affect some features of the Site.

7. Data retention

We retain Site inquiry information for as long as needed to respond and maintain our business records. Call recordings and transcripts are retained according to the retention settings agreed with the relevant Customer and are deleted or anonymized when no longer needed for the purposes described in this policy, unless a longer period is required by law.

8. Security

We use administrative, technical, and physical safeguards designed to protect the information we process, including encryption in transit, access controls, and logging. No method of transmission or storage is completely secure, so we cannot guarantee absolute security, but we work to protect your information and to respond promptly to any incident.

9. Your rights and choices

Depending on where you live, you may have rights to access, correct, delete, or receive a copy of your personal information, to object to or restrict certain processing, and to withdraw consent where processing is based on consent. To exercise these rights, contact us at hello@hummingagent.ai. If your request concerns a call made to one of our Customers, we may refer you to that Customer or work with them to fulfill the request. We will not discriminate against you for exercising your privacy rights.

10. Children's privacy

The Site and the Service are intended for businesses and are not directed to children under 16. We do not knowingly collect personal information from children. If you believe a child has provided us personal information, contact us and we will delete it.

11. International visitors

We are based in the United States and process information there. If you access the Site or interact with the Service from another country, you understand that your information will be processed in the United States, where data protection laws may differ from those in your jurisdiction. Where required, we use appropriate safeguards for such transfers.

12. Changes to this policy

We may update this Privacy Policy from time to time. When we do, we will revise the effective date above and post the updated policy on this page. Material changes will be communicated through the Site or, for Customers, by direct notice.
